The Secretariat of Com­mittee of Experts (CoE) has developed an Operational Plan: 2009-2010 under the theme Towards a Harmonized & Acceptable Constitution as a guiding tool in the implementation of its work. Under the plan the CoE will implement four programmes namely, Re­search, Drafting & Technical Support, Finance & Ad­ministration, Mobilization, Logistics & Outreach, and Civic Education & Public In­formation.

These programme areas are driven by the overall ob­jective of producing an ac­ceptable Constitution.

It must be recognised that constitution-making process world over is always expensive.

That is why we consider it crucial that financial independ­ence for the CoE and the secretariat be ensured. It is equally important that the review process secure po­litical consensus and agree­ment if we have to avoid the type of political disagree­ment that characterised the 2005 referendum.

Failure to secure political consensus and agreement is therefore a real threat no only to Kenyans but also to the work of the CoE.

There is overriding need for the public to understand and effectively participate in this process. The challenge remains that of dealing with the misconceptions by some sections of the public that the CoE would replicate the CKRC process and other initiatives before it.

To reach a harmonized Con­stitutional Draft, which is the ultimate mandate of the CoE, it is essential that the CoE undertakes sufficient civic education to bring eve­ryone on board.

Tied to a harmonized consti­tutional result is the need to secure an affirmative refer­endum result.
